
Marcus Overhui from Priority Title spoke to us about title insurance. Title insurance insures against title defects and past events such has unpaid liens. It is not a requirement for a buyer but is good as long you own the property covered by the insurance policy. Marcus described both the Owner’s policy and lender’s policy. The Lender’s policy is for the life of the loan covering the property. Marcus talked about finding title information and what information they look for in the title search. He described what is included in the title commitment, what is excepted, and what kind of requirements need to be met to issue the title policy. He also described common title issues such as encroachments, survey errors, boundary disputes, and discussed what happens when an owner dies or the property is involved in a divorce. Premiums for title insurance are regulated by State of Texas. Thus, all title companies charge same price; however, other title company fees can be different.
